Dear Chairperson Alberti: Regarding the application for a Retailers Class C License for Shaws Tavern, LLC, 520 Florida Avenue, NW, and the establishments request for support for stipulated and permanent ABC licenses: Advisory Neighborhood Commission 2C conducted a public meeting on Wednesday, December 14, 2011, at the Kennedy Recreation Center, 1401 7th Street, NW, to consider the above request. At the Commissions meeting, duly noticed and with this case listed in the notice, with a quorum present (three out of four Commissioners required to be in attendance to achieve a quorum), ANC 2C voted (3 in favor, none opposed, and one abstention) to support the issuance of stipulated and permanent Retailers Class C licenses to Shaws Tavern, LLC, and to communicate said approval in writing to the Alcoholic Beverage Control Board.

In considering this case, and as a result of questioning of the applicants representatives present at the meeting, the Commission considered and determined the following: 1) The establishment will operate as a tavern, with entertainment and sidewalk cafe. The establishment expects the majority of patrons to be neighborhood residents, so no significant street parking burden is anticipated. However, the new owner of the business, Siyamak Sadeghi, indicated he would explore engaging a valet parking firm to reduce potential parking impacts on the neighborhoods streets. 2) The Commission and the community support additional dining establishments in the neighborhood, which are seen as a desirable amenity. 3) Mr. Sadeghi, who has acquired the LLC that will operate Shaws Tavern, is a neighborhood resident with experience managing Axis Bar & Grill, formerly located on U Street, NW. Mr. Sadeghi stated he will be a hands-on manager at the establishment, and that he is familiar with District of Columbia ABC regulations. 4) The applicant acknowledged that the establishment is located in a residential area, and accordingly, to address potential noise impacts on neighbors, there will be no live or recorded music in the outdoor seating area. As hours for entertainment in the outdoor seating area were included in the application, the Commission accepted Mr. Sadeghis statement to mean he will amend his application to clarify that there will be no outdoor entertainment provided by the establishment at any time. This is a condition of the Commissions support for the application. 5) In addition, to address concerns about potential club promotions on the premises, as stated in the application, there will be no dance floor at the tavern, and the only music inside will be live Jazz or classical music. 6) No objections were raised to the issuance of the licenses. Under the conditions and for the reasons listed above, Advisory Neighborhood Commission 2C recommends that the Alcoholic Beverage Control Board approve this application and issue these licenses, and accord the Commissions recommendation Great Weight as provided in the ABC statute.
